Terms of Service

0. Business Customers Only

This service is offered exclusively to business customers (B2B). Contracts with consumers are excluded.

1. Scope

These Terms apply to all agreements between Reef Digital Services GmbH ("Provider") and users of the NotShot catalog rendering platform.

2. Subject of Contract

The Provider offers a Software-as-a-Service (SaaS) catalog rendering platform that produces AI-generated catalog photography from operator-supplied garment and model imagery.

3. Registration & Contract

Use requires registration. A contract is concluded once the user completes registration and the Provider confirms it.

4. Prices & Payment

Use of the platform is metered in credits. Credits are purchased in advance via the Provider's payment processor and consumed per render and tuning operation according to the published rate. Credits are of two kinds. Credits included with a recurring subscription plan are valid only for the billing period in which they are granted and do not roll over; any unused subscription credits are reset at each renewal. Credits purchased separately as one-off credit packs do not expire and remain valid for the duration of the account. Failed renders that produce no usable output are automatically refunded to the credit balance.

5. Termination

Both parties may terminate the contract with 14 days' notice to the end of the month. On termination, unused prepaid credits are non-refundable except where required by law.

6. Acceptable Use

The user warrants that uploaded garment and model imagery does not contain, and is not intended to produce renders containing, any of the following:

  • Sexually explicit, pornographic, or otherwise adult-only material.
  • Hate symbols, slurs, or content directed against ethnic, religious, or sexual identity groups.
  • Depictions of real-world violence, gore, or weapons used aggressively.
  • Child sexual abuse material (CSAM). The Provider is required by German § 184b StGB to report suspected CSAM to the Bundeskriminalamt; user accounts found in violation will be terminated immediately and reported.
  • Third-party brand imagery, copyrighted artwork, or trade-marked references the user does not have rights to use.
  • Imagery of identifiable individuals without their consent.

The Provider operates an automated content-classification gate at upload time + an admin moderation queue, and reserves the right to refuse uploads, delete renders, or terminate accounts for breach of this section without prior notice. Repeated or wilful breach is grounds for immediate termination.

7. Liability

The Provider is only liable for intent and gross negligence. Liability for data loss is excluded if the user has not implemented reasonable backups of their uploaded source material.

8. Jurisdiction

German law applies. The place of jurisdiction is Berlin, Germany.

9. AI-Generated Content & EU AI Act (Regulation (EU) 2024/1689)

Synthetic outputs. All images produced by the platform are artificially generated / synthetic media created by AI systems from operator-supplied inputs. They do not depict real photographic events, and the depicted persons are AI-generated and are not real individuals.

Art. 50 transparency. As the provider and deployer of a generative AI system, Reef Digital Services GmbH marks generated image outputs in a machine-readable format as artificially generated, in accordance with Article 50(2) of Regulation (EU) 2024/1689. Marking is applied via C2PA Content Credentials (a signed provenance manifest embedded in the delivered image, asserting trainedAlgorithmicMedia per the C2PA / IPTC vocabulary).

Your disclosure duty. Where you publish, distribute, or otherwise make available outputs that constitute an image of real-looking people or scenes, you are responsible for disclosing that the content has been artificially generated or manipulated to the extent required by Article 50 and applicable law. You must not remove, strip, or alter the machine-readable markings we apply.

Prohibited uses. You may not use the platform or its outputs for any practice prohibited under Article 5 of the EU AI Act, nor to produce misleading deepfakes, impersonation, deceptive or unlawful content, or content that infringes third-party rights.

Version. This notice forms part of the Terms. The version you accepted at registration is recorded against your account.
